Theft & Property Crime Defense

Theft charges in Ohio are classified by the value of the property involved. A small difference in that amount can mean the difference between a misdemeanor and a felony. Property crime charges also include burglary, breaking and entering, vandalism, and receiving stolen property — each with its own penalties and defenses.

Other Property Offenses

Burglary

Entering a structure with intent to commit a crime. Charge level depends on whether anyone was present and whether the structure was occupied as a dwelling.

Breaking and Entering

Entering without permission by force or deception. Different from burglary — typically a lower felony but still a serious charge.

Receiving Stolen Property

Knowingly possessing property that was stolen. Does not require you to have committed the underlying theft — possession with knowledge is enough.

Vandalism / Criminal Damaging

Damaging property without consent. Charge level depends on the cost of damage and who the property belongs to.

Shoplifting (Petty Theft)

Taking merchandise from a retail establishment. Ohio allows civil recovery by retailers in addition to criminal charges.

Identity Theft

Using another person's identifying information without consent. Can be charged as felony regardless of the monetary value involved.
