Assault & Violent Offense Defense
Assault charges in Ohio range from a first-degree misdemeanor to a first-degree felony. The distinction matters enormously. Context, the relationship between parties, any weapons involved, and the extent of alleged injury all affect the charge level — and all of them can be examined and challenged.
Ohio Assault Charges Explained
Simple Assault (Misdemeanor 1)
Knowingly causing or attempting to cause physical harm to another person. Up to 180 days in jail and a $1,000 fine. This is a first-degree misdemeanor in most circumstances.
Aggravated Assault (Felony 4)
Knowingly causing serious physical harm, or causing physical harm with a deadly weapon, under provocation. 6–18 months in prison. Distinguishable from felonious assault by the element of serious provocation.
Felonious Assault (Felony 2)
Knowingly causing serious physical harm, or causing harm with a deadly weapon or dangerous ordnance — without a provocation mitigator. 2–8 years in prison. This is one of the most serious assault charges.
Assault on a Peace Officer (Felony 4)
Assault on a law enforcement officer, firefighter, or other protected class of worker is charged as a fourth-degree felony regardless of injury level. Penalties are significantly elevated from standard assault.
Defense Approaches
Assault cases often turn on disputed facts — what happened, who initiated contact, what the level of injury actually was, and whether the defendant acted in self-defense or defense of another.
Ohio law recognizes self-defense as an affirmative defense to assault and other violent offenses. Under Ohio's self-defense law, if a person reasonably believes that force was necessary to protect themselves or another person from imminent harm, that use of force may be justified. The prosecution bears the burden of disproving self-defense beyond a reasonable doubt once the defense is raised.
Other relevant issues include: witness credibility, inconsistencies in the complainant's account, medical record review, surveillance or body camera footage, prior history between parties, and whether the charge level accurately reflects the actual conduct.
