Assault charges in Ohio range from a first-degree misdemeanor to a first-degree felony. The distinction matters enormously. Ohio Assault Charges Explained

Simple Assault (Misdemeanor 1)

Knowingly causing or attempting to cause physical harm to another person. Up to 180 days in jail and a $1,000 fine. This is a first-degree misdemeanor in most circumstances.

Aggravated Assault (Felony 4)

Knowingly causing serious physical harm, or causing physical harm with a deadly weapon, under provocation. 6–18 months in prison. Distinguishable from felonious assault by the element of serious provocation.

Felonious Assault (Felony 2)

Knowingly causing serious physical harm, or causing harm with a deadly weapon or dangerous ordnance — without a provocation mitigator. 2–8 years in prison. This is one of the most serious assault charges.

Assault on a Peace Officer (Felony 4)

Assault on a law enforcement officer, firefighter, or other protected class of worker is charged as a fourth-degree felony regardless of injury level. Penalties are significantly elevated from standard assault.
